These Terms of Service (“Terms”) govern your use of Booky’s point-of-sale (POS) software, services, and website (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use Booky.

  1. ACCEPTANCE OF TERMS

By creating an account, accessing, or using Booky’s Service, you confirm that you:

  • Are at least 18 years old and have the legal capacity to enter into a binding contract.
  • Agree to comply with all applicable laws and regulations.
  • Have read, understood, and accepted these Terms.
  1. SERVICES PROVIDED

Booky provides an all-in-one scheduling and POS software solution designed for small businesses, including salons, retail stores, and restaurants. Our core services include:

  • Automated scheduling & booking tools
  • Dynamic Overlap Scheduling™ to maximize appointment slots
  • Point-of-sale (POS) payment processing
  • Customer management & engagement features
  • Business performance tracking & analytics
  • Third-party integrations with CRM, payment gateways, and industry-specific software

We continually innovate and expand features. Updates and modifications to the Service are at Booky’s sole discretion.

  1. ACCOUNT REGISTRATION & SECURITY
  • You must provide accurate, current, and complete information when registering.
  • You are responsible for maintaining the security of your login credentials.
  • You must notify us immediately if you suspect unauthorized access to your account.
  • Booky is not liable for losses resulting from compromised account security.
  1. PAYMENT & SUBSCRIPTION

Booky operates on a subscription-based model with transparent, flat-rate pricing.

  • Billing & Payment: You agree to pay all fees associated with your selected plan. Payments are billed monthly or annually, depending on your subscription.
  • Trial Period: New users may access a 14-day free trial with no credit card required.
  • Refund Policy: All payments are non-refundable unless otherwise required by law.
  • Upgrades & Downgrades: You may modify your subscription at any time. Changes take effect on the next billing cycle.

Failure to pay fees may result in suspension or termination of your account.

  1. ACCEPTABLE USE POLICY

By using Booky, you agree not to:

  • Use the Service for fraudulent, illegal, or unauthorized activities.
  • Upload or transmit harmful software, viruses, or malicious code.
  • Interfere with the normal operation of the Service or attempt unauthorized access.
  • Misuse or exploit Booky’s platform for competitive research or reverse engineering.

Violation of this policy may result in suspension or termination of your account.

  1. DATA PRIVACY & SECURITY

Your privacy is important to us. By using Booky, you consent to our Privacy Policy, which outlines:

  • How we collect, store, and protect user data.
  • How we comply with applicable data protection laws.
  • How we integrate with third-party services while ensuring security.

We implement industry-standard security measures but cannot guarantee absolute data security. Users are responsible for safeguarding their personal and business information.

  1. THIRD-PARTY INTEGRATIONS

Booky integrates with third-party services such as:

  • Payment Processors: Stripe, Square, PayPal
  • Marketing & CRM Tools: Google, Facebook, Mailchimp
  • Accounting & Inventory Systems

By using these integrations, you acknowledge that Booky is not responsible for any data breaches or service disruptions caused by third-party providers.

  1. TERMINATION & SUSPENSION

Booky reserves the right to suspend or terminate your account under the following conditions:

  • Violation of these Terms or any applicable laws.
  • Failure to pay subscription fees.
  • Abusive, fraudulent, or unauthorized use of the Service.
  • Request by law enforcement or regulatory authorities.

If your account is terminated, your data may be deleted permanently.

  1. DISCLAIMERS & LIMITATION OF LIABILITY
  • No Warranty: Booky is provided “as is” and “as available” without warranties of any kind. We do not guarantee that the Service will be error-free, uninterrupted, or meet your specific business needs.
  • Limited Liability: To the fullest extent permitted by law, Booky is not liable for any indirect, incidental, or consequential damages arising from your use of the Service.
  • Indemnification: You agree to indemnify and hold Booky harmless from any claims, damages, or expenses resulting from your use of the Service.
  1. MODIFICATIONS TO TERMS

Booky reserves the right to modify these Terms at any time. We will notify users of significant changes via email or an in-app notification. Your continued use of the Service after updates constitutes acceptance of the revised Terms.

  1. GOVERNING LAW & DISPUTE RESOLUTION
  • These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law principles.
  • Any disputes shall be resolved through binding arbitration in Ontario, Canada, unless otherwise required by law.
